Carol prepares Employment Agreements which include comprehensive compensation plans, termination clauses, non-compete clauses, non-solicitation clauses, and confidentiality clauses. She has also acted as counsel on behalf of both Employees and Employers regarding the enforceability of Employment Agreements. Carol is able to quickly identify the pitfalls in Employment Agreements. She has prepared Employee Policy Manuals, Management Manuals and conducted seminars for Corporate Employers.

Carol's in-depth knowledge and extensive experience in Employment Law enable her to quickly identify the legal issues and extract the relevant facts. Carol's superior analytical abilities allow her to formulate the best strategic approach to each case. Her sharp intellect and analytical abilities are complemented by strong negotiation skills. Carol's astute judgment, common sense approach and strong negotiation skills enable her to obtain optimal results on behalf of her clients in the early stages of the case.

Carol's strategic approach to cases and her strong initiative are clearly evidenced by her soliciting the Director of Employment Standards (Ministry of Labour) to intervene at the appellate level regarding the interpretation of the Ontario Employment Standards Act, 2000. Although Carol was not counsel for either party in this case (Patrick Boland v. APV Canada Inc., Ontario Superior Court of Justice, Divisional Court), she was the counsel that approached the Ministry of Labour to intervene at the appellate level because the trial judge's erroneous decision was adversely impacting her client's case. The Ministry of Labour intervened and the appellate court overturned the trial judge's decision.

Carol has also undertaken training in Alternative Dispute Resolution including mediation through the Program on Negotiation at Harvard Law School. In addition to her mediation training at Harvard Law School, Carol completed the Advanced Dispute Resolution Program with the Stitt Feld Handy Group. Her experience in human rights law originates back to law school when she worked for the British Columbia Human Rights Council (BCHRC) providing legal opinions to the BCHRC on various legal human rights issues. She has conducted workplace investigations including interviewing witnesses and reviewing and analyzing documents. Carol's human rights experience, extensive knowledge in employment law and mediation training provide her with the framework to facilitate resolutions in the workplace.

Carol has appeared before various levels of court including appearing twice before the British Columbia Court of Appeal, where she was successful on both occasions.

Carol has successfully negotiated settlements on behalf of Employee clients against

  • other industry Corporations, including small privately owned ones.
